It'd be a shame to lose it, if he can't release it hopefully he can at least get it into a digital archive somewhere until the legal problems are over.

It entirely depends who owns the copyright at this point. If it's owned by Microprose (or a successor company), and he distributes it, free or not, I imagine he'd be liable. Particularly if he's the only one who has the game. He'd be an easy target if it suddenly popped up online.
But, I'm not a lawyer, and it's been a long time. He may have the rights by now.

It'd depend if it was copyright or trademark, one lasts significantly longer than the other...although since I am also not a lawyer I don't know how it applies to things that weren't released. Xerxes might know but it's quite hard to summon him.

Great news! Daniel Auld replied to me and not only is he willing to send a copy of the game to me, he is going to do so for free! Check it out: Ahh ok, I see. Thanks for your speedy response So, am I able to perhaps purchase a copy of the 95% completed version from you, or is the game still technically tied up in legal issues? No need to purchase, if you give me an address I'll try to get a copy out to you (it will be a burned copy of the beta version that was being tested before the project got shelved). Dan This guy is a legend. Get excited guys

I am shocked if this happens because it seems so simple, a completely lost game been made available suddenly.

I am shocked if this happens because it seems so simple, a completely lost game been made available suddenly. I know right? I fully expected him to tell me that he couldn't release it for one reason or another, was totally surprised. Anyway I will let you guys know if/when (hopefully when) it arrives. Edit: Decided to take a screenshot of our correspondence to dispel any doubts there may be about its legitimacy:

BAM! mega.co.nz upload (240MB .zip)Straight from Daniel Auld himself! For the record, he's happy for me to share the game around online. This dude is awesome, he even printed off a cover inlay for me (high-res scan available in above .zip, along with the actual .iso file). Enjoy, guys! P.S. For those curious, the disc is labelled "Necrobius Beta - Circa 1996, May".

Well I tested it and it works, there's instant game overs though so save regularly still I'm a fan of early mid 90s surreal video games so this is pretty amazing. Interesting the copyright information in the game is from 1993, suggesting it was 3 years in development I guess...there seems to be a framing device plot that isn't explained in the game.

Thanks for going the extra mile making this available! I'm going to test it in DOSBox running 3.1 Well I tested it and it works, there's instant game overs though so save regularly still I'm a fan of early mid 90s surreal video games so this is pretty amazing. You might like my next article then. Zeddas: Servants of Sheol. Here's a screenshot I managed to find of the long-lost second game that never came out of Japan, known as Horror Tour 2.

You'll need to relink that, try a different web host but Servants of Sheol looks pretty cool. Played a little more Necrobius - got stuck but I'm sure the game is going to be fairly obtuse.

Will be interested to check this out when I get the chance! How well does it work on XP and/or Windows 7?
Zeddas sounds really cool. It's sparking another hunt for some lost Japanese games - there are three games in the Horror Tour series, but the second seems extremely difficult to find, and the third seems to exist in no place outside of a listing on Amazon Japan, so it might not have been released. Hopefully when I publish this article it will spark some people to begin hunting for it.

I ran it through an instance of VMWare, it uses Macromedia director (I believe) so it should probably run okay in XP regardless with some messing around - I didn't bother trying it on Win7. Worth noting the audio mix might be not-final as some of the dialogue is almost inaudible under the music.
