This is not the "games you hope will be re-released" thread. This is not the "games that companies haven't gotten around to re-releasing yet" thread. This thread is for those games that we can state, with near-certainty, will never see the light of day again in any official form.
Too Human, anyone?
Following Silicon Knights' catastrophic court loss to Epic Games, the studio not only closed, but the court ordered all copies of Too Human to be destroyed. Now, granted, by 2012, there weren't a whole lot of unsold copies of the game out there, but the order certainly guarantees that this game will never be released in any form ever again. Couple that with its developer being defunct and Denis Dyack being a pariah in the industry, and SK's other games are probably not seeing a rerelease anytime soon either. Kingdoms of Amalur: Reckoning is another prominent one. It was funded by the state of Rhode Island, which seized the rights when the game flopped and 38 Studios imploded. Curt Schilling quit the industry afterward too and will almost certainly never be back.

And how about Uniracers?
The game was subject to a lawsuit from Pixar (pre-Toy Story) alleging that the red unicycle was ripped off from their short film Red's Dream. Nintendo agreed to halt production of the game, and since they own the IP, there is virtually zero chance of it ever being released again. Furthermore, the game's developer, DMA Design (aka Rockstar North), has moved onto much bigger and better things since then, so I doubt they care either.

Oh fuck Pixar for ever doing that stupid lawsuit! This game really kicks ass and it really shows that the SNES WAS capable of doing Blast Processing (yeah, stupid marketing gag insert but still!). I really wished Rockstar made more cartoonish games, i mean look at Space Station Silicon Valley on the N64

Here are some from the Atari Jaguar pantheon:
- Super Burnout: According to Olivier Nallet (the game's programmer who i'm also friend of) stated that the source code to the game is lost.
- Attack of the Mutant Penguins: While Wayne Smithson (the game's programmer who i'm also friend with) has stated on a Facebook-dedicated Jaguar group that he still has the rights to the game, all of the game's assets including the source code are completely lost somehow...
- BattleSphere: One of the developers had a issue with Albert from AtariAge behind the scenes and as a result, Albert had to remove everything related to the game from his website. Other issues have also contributed to the game not being released such as piracy and the developers moving on from the project after BattleSphere Trio.
Here's one that somehow has never been re-released...:
- Zoop: Although Viacom International started a new gaming divisiĂłn called 345 games in 2011, they somehow have never re-released Zoop. Which is too bad as its a pretty fun puzzler.

Soul Blazer. The game has like 3 different music copyrights. Either SquareEnix pays the copyright owners or they compose new music for it. I don't think either will ever happen.

Primarily stuff that doesn't have any modern devs with interest and rights due to end-of-PS-era collapses. What happened to Zeque, developer of Kowloon's Gate and Planet Laika? Nobody knows, so good luck with that. Atlus may still be around, but have shown no interest in even acknowledging having published Dennou Eizou's games. Many Human properties vanished too, so we're lucky to have the few that survived.
From a similar time period, "windows 3.1 games without the source code", according to Night Dive; if they can't port the game away from requiring a copy of Win3.1 to run, they can't release the game legally.

Speaking of Night Dive they tried to re-release the NOLF games but no one knows who owns the rights anymore, so it's unlikely to ever happen.
Fans have taken it upon themselves to make patched versions that can run on modern hardware available for free, but official re-releases would give these sorely underrated games more attention.
And two games I'd file in the "if it hasn't happened by now it probably won't" folder are the Myst style graphic adventures 9: The Last Resort and Obsidian.
Now it's certainly not impossible but 9 is probably another case of no one knows who owns the rights as it was produced by Robert De Niro of all people, who probably doesn't even remember the game exists.
And in the case of Obsidian it's probably simply too obscure.
Of course some unexpected stuff has popped up on GOG over the years so never say never.

I'd be shocked if Moonlight Syndrome ever gets another chance given how wholly twisted it is. The Guy Game will likely never be rereleased, given that it was revealed after the game's release that it featured footage of a topless 17-year-old girl without her consent. How does that even happen? The game looked like raw sewage, but I imagine she had to know what she was getting into, unless it was some kind of setup. And yeah, lol at Metal Wolf Chaos. I'm as shocked as anyone, but it's back.

I think the demand for a re-release of Konami’s Nanobreaker (by Koji Igarashi) is pretty low. One day no one will remember it even existed.
I’m also reasonably certain we’ll never see Strider Returns again, in any shape or form.

It's literally a tiny nondescript bike riding a line.
